This agreement is between
Gleimlight Photography & Productions
, referred to as the
PHOTOGRAPHER
, and an independent contractor whose name and address appears above, referred to as the
CONTRACTOR
.
ASSIGNMENT:
The contractor agrees to work as primary or secondary shooter, on the agreed date(s).
INDEPENDENT CONTRACTOR:
The contractor and the photographer hereby specifically agree that the contractor is performing the services as an independent contractor and is not an employee of the photographer. Nothing in this agreement shall be construed as creating an employer-employee relationship, as a guarantee of future employment or engagement, or as a limitation upon the photographer's sole discretion to terminate this agreement at any time without cause. The contractor further agrees to be responsible for all of contractor’s federal and state taxes, withholding, Social Security, insurance and all other benefits. The contractor shall have no claim against Gleimlight Photography & Productions hereunder or otherwise for vacation pay, sick leave, retirement benefits, social security, worker’s compensation, health or disability benefits, unemployment insurance benefits, or employee benefits of any kind.
MEMORY CARDS:
The contractor agrees to hand over all memory cards before leaving the event to the photographer. The photographer will download the cards and send the RAW files back to the contractor in a timely manner, via Google Drive or in-person. If a representative of Gleimlight Photography & Productions is not present at the event(s) a separate pickup & drop off arrangement will be made. SD Cards will be provided by the photographer unless other arrangements are agreed upon in writing in the form of an email or text communication.
COPYRIGHT:
The contractor agrees the
images are owned by the photographer
. The contractor agrees not to sell any image taken during a contracted event from the photographer to any person, company, group, advertising agency or otherwise without the photographer express written permission. The contractor will receive a limited release form upon delivery of RAW images.
USAGE:
The photographer grants the contractor permission to use the images taken during the contracted event for the contractor’s print portfolio, website or social media.
All images used on the web or in social media must give full credit.
It should include a “photographed for Gleimlight Photography & Productions” statement with a link to
https://www.gleimlight.com
.
Images shared on social media must also tag "@GleimlightPhotography" for Instagram and "@GleimlightPhotography" for Facebook.
The contractor must wait to post the images online until 8 weeks after the event(s) date of release.
Date of release will be determined by when the photographer releases the images to the public via online or social media use.
This is to protect client interests.
CLIENT INTERACTION:
The contractor may not Facebook friend or accept a friend request from a client or their event(s) guests. The contractor cannot mention the clients by name in any of their usage of their images, online or print.
BUSINESS REPRESENTATION:
The contractor will be given the photographer's business cards to hand out during the event(s). The contractor will refer to themselves as a
photographer or videographer
for Gleimlight Photography & Productions. The contractor is not permitted to promote his or her own business during the event(s). This includes networking with other vendors, only the photographer's business information should be given out. Failure to comply will serve as a breach in contract, allowing the photographer to withhold any money due to the contractor.
LIABILITY:
The contractor warrants that he/she will perform when booked for a photographic assignment and that he/she is liable for any loss or other financial liability suffered by the photographer due to failure to perform other than a documented medical emergency or an “Act of Nature.” The photographer is not liable for any loss or damage to the contractor’s equipment under this contract.
EQUIPMENT:
The contractor is responsible for providing all of his/her own equipment with which to complete the assignments. The photographer requires that weddings be photographed in RAW format and that all original digital files are relinquished to the photographer upon completion of the contracted job. The contractor will be responsible for using equipment supporting dual writing. The contractor will ensure their camera is writing simultaneously on both provided SD cards. Gear may be provided to the contractor in which case a direct agreement would be made via text message or email.
DAY OF CONDUCT:
Contractor will dress in appropriate clothes and will appear neat and clean. The contractor will call the photographer in the event of an emergency or delay at (619) 451-9461. The contractor must perform with a positive and professional attitude.
FAILURE TO ATTEND:
In the event that that contractor fails to arrive to the pre-scheduled event(s), they will be held liable to any damages the photographer incurs. If the event(s) can be rescheduled, the contractor will be liable for a reshoot.
PAYMENT:
The photographer will pay the contractor within 48 hours of the event(s) completion and once all of the photographers assets & RAW images have been returned.
If performing as primary shooter: 40% of the event(s) total.
If performing as secondary: 30% of the event(s) total.
COMMISSION:
In the event a contractor refers a client to Gleimlight Photography & Productions, they will have the first choice to shoot the event. Commission will be paid out as follows:
If the contractor completes the event(s) as primary shooter they will receive 50% of the event(s) total.
If the contractor completes the event(s) as a secondary shooter they will receive 40% of the event(s) total.
If the contractor simply is the source for the client but does not perform any work during the event(s) they will receive 15% of the event(s) total.
This agreement constitutes the full agreement of the parties. Any modification of this agreement must be in writing and signed by both parties. If any provision of this agreement is declared invalid, then the remainder of the agreement will remain in force and in tact. I have read and agree to the terms of this contract.
